As of May 2013, there is no legal text dealing exclusively with REDD+ in the Republic of Congo. According to discussions, the legal framework for REDD+ will be established by a framework law that will embody the guiding principles for the implementation of REDD+ in the Congo. This law will be based on Law no. 3-91 of 23 April 1991 on the protection of the environment, which will be modified and adapted in order to become a REDD+ framework law. The legal framework for REDD+ will clarify the roles and responsibilities of public authorities, identify strategic priorities and outline the fundamental principles and instruments of implementation, including incentives.
In addition to Law No. 3-1991 of 23 April 1991 on the protection of the environment, other laws relevant to the implementation of REDD+ include Law No. 16-2000 on the Forest Code which defines the fields of forestry, identifies the authorities and procedures for forest management in the Congo, Law n ° 17-2000 of 30 December 2000 on the land which defines land law and details registration procedures for obtaining titles, Law No. 9-2004 of March 26, 2004 on the code of the domain of the State, which codifies the domain of the State, the private and the public domain (which includes terrestrial public domain and all natural resources therein), and Law No. 10-2004 of 26 March 2004 laying down the general principles applicable to federal and land regimes which recognises private property and customary land law.
Another relevant law for the implementation of REDD+ is Law No. 5-2011 of 25 February 2011 on the promotion and protection of indigenous peoples, passed as a response to the UN Declaration on the Rights Indigenous peoples (UNDRIP), which recognises the importance of developing culturally appropriate consultation mechanisms for indigenous peoples (Law No. 5-2011).
